Software piracy has become recognized as a major problem for the software industry and for business. One research approach that has provided a theoretical framework for studying software piracy has been to place the illegal copying of software within the domain of ethical decision making assumes that a person must be able to recognize software piracy as a moral issue. A person who fails to recognize a moral issue will fail to employ moral decision making schemata. There is substantial evidence (...) that many individuals do not perceive software piracy to be an ethical problem. This paper applies social exchange theory, in particular equity theory, to predict the influence of situational factors on subjects' intentions to participate in software piracy. Consistent with the predictions of equity theory this study found that input and outcome situational variables significantly effect a person's intentions to commit software piracy. (shrink)

Richard Dawkins has a dilemma when it comes to design arguments. On the one hand, he maintains that it was Darwin who killed off design and so implies that his rejection of design depends upon the findings of modern science. On the other hand, he follows Hume when he claims that appealing to a designer does not explain anything and so implies that rejection of design need not be based on the findings of modern science. These contrasting approaches lead (...) to the following dilemma: if he claims that Darwinism is necessary for rejecting design, he has no satisfactory response to design arguments based on the order in the laws of physics or the fine-tuning of the physical constants; alternatively, if Humean arguments are doing most of the work, this would undermine one of his main contentions, that atheism is justified by science and especially by evolution. In any case, his Humean arguments do not provide a more secure basis for his atheism because they are seriously flawed. A particular problem is that his argument for the improbability of theism rests on a highly questionable application of probability theory since, even if it were sound, it would only establish that the prior probability of God’s existence is low, a conclusion which is compatible with the posterior probability of God’s existence being high. In the final scene of Michel Tournier’s postcolonial novel La Goutte d’or, the protagonist, Idriss, shatters the glass of a Cristobal & Co. storefront window while operating a jackhammer in the working-class Parisian neighbourhood on the Rue de la Goutte d’or. Glass fragments fly everywhere as the Parisian police arrive. In La Goutte d’or, Tournier explores the identity construction of Idriss through a discussion of the role that visual images play in the development of a twentieth-century consciousness of (...) the “Other.” At the beginning of the novel, a French tourist takes a photograph of Idriss during her visit to the Sahara. The boy’s quest to reclaim his stolen image leads him from the Sahara to Marseille, and finally to the Rue de la Goutte d’or in Paris. The Rue de la Goutte d’or remains one the most cosmopolitan neighbourhoods of the city. In Tournier’s novel, the goutte d’or also corresponds to a symbolic object: a Berber jewel. It is the jewel that Idriss brings with him, but which he also subsequently loses upon his arrival in Marseille. From the very moment that the French tourist photographs him, a marginalization of Idriss’s identity occurs. Marginality, quite literally, refers to the spatial property of a location in which something is situated. Figuratively speaking, marginality suggests something that is on the edges or at the outer limits of social acceptability. In this essay, I explore the construction of the marginalized postcolonial self through an examination of the function of visual representation in the development of a postcolonial identity in La Goutte d’or. In the end, I conclude that the construction of a postcolonial identity is based upon fragmentation and marginalization, which ultimately leads its subject to create an identity based upon false constructions. Bernstein THE RAGE AGAINST REASON Recently, a number of phflosophers including Alasdair Maclntyre, Richard Rorty, Paul Ricoeur, and Jean-François Lyotard have reminded us about die centred (and problematic) role of narratives for philosophic inquiry. I say "reminded us" because narrative discourse has always been important for philosophy. Typically, every significant philosopher situates his or her own work by telling a story about what happened before (...) he or she came along— a story that has its own heroes and villains. This is the way in which philosophers are always creating and recreating dieir own traditions and canons. And die stories that they tell are systematically interwoven with what they take to be their distinctive contributions. Consider Aristotle's narrative in die first book of me Mdaphysics about the insights and blindnesses of his predecessors in grasping the multidimensional character of our scientific knowledge of causes. Or — to leap to the contemporary scene — think of the story that logical positivists told us about the confusions and linguistic blunders of most of their predecessors — with a few bright moments of anticipation of their own radical program for reforming phdosophy. Or again, there is the powerfully seductive story diat Husserl tells where the entire history of philosophy is viewed as a teleological anticipation of die new rigorous Wissenschaft of transcendental phenomenology. There is a common rhetorical pattern in these narratives. They tell stories ofanticipations, setbacks, and trials, but they culminate with the progressive realization of truth and reason, which is normally identified with what die philosopher/ storyteller now sees clearly — a "truth" which his or her predecessors saw only through a glass darkly. There is also die genre of philosophic narratives which has become so fashionable in the nineteenth and twentieth centuries and has dramatically reversed diis pattern. They tell of relentless decline, degeneration, catas186 Richard J. Bernstein187 trophe, and forgetfulness. A "classic" instance of this is Nietzsche's geneological unmasking of the "history" of reason, truth, and morality which culminates in the dominance and spread of a pernicious all-encompassing nihilism. But we also find variations of this pattern in Maclntyre's saga of the decline and degeneration of moral phdosophy and moral life since me Enlightenment. And — as we shall see — diis is die way in which Heidegger reads (in his "strong reading") the destiny of Western philosophy and metaphysics which is interwoven with the history of the forgetfulness and concealment of Being. It is not my intention to develop a typology of narrative patterns in philosophy, although I am convinced that such a typology would be extremely üluminating. Rather I want to set a context for what I will attempt to do in this article. For I want to oudine a narrative — or more accurately and modestly — a narrative sketch. Even diough I will be schematic, my tale is a complex one for several reasons. First, because it is a narrative about narratives, specifically narratives which themselves relate stories about the development of reason, or what thinkers such as Weber and Habermas call "rationalization" processes,1 Secondly, because it is a narrative that isolates different story lines, a plot and a counterplot that stand in an uneasy and unresolved tension with each odier. Thirdly, because it is not one of those narratives where all the loose threads are neady tied together at die end — or to switch metaphors, there is no grand Aufhebung because it is essentially an unfinished story. In the spirit of this prologue let me introduce die four main characters ofmyfirst story line, and tell you what I hope to achieve. The names of the main characters are Condorcet, Weber, Adorno, and Heidegger. My aim is to confront some deeply troubling contemporary questions, for I want to understand why today there are so many "voices" screeching about Reason. Why is there a rage against Reason? What precisely is being attacked, criticized, and damned? Why is it diat when "Reason" or "Rationality" are mentioned, they evoke images of domination, oppression, repression, patriarchy, sterility, violence, totality, totalitarianism, and even terror? But since the Greeks first wrote what they called tragedies and comedies, and Aristotle in The Poetics formulated some distinctions about them, writers have been conscious of the two modes as engaging them in different undertakings, involving them in different worlds, each with its own demands. They have gauged their predilections and capacities against the demands of each and have deliberately chosen one or the other, or some calculated mixture. They are often quite explicit about it. Shakespeare announced his plays (...) as "tragedies" or "comedies" or, when he chose, he mixed the forms with the recklessness of Polonius. Marlowe spoke his intention when in the Prologue to Tamburlaine he asked his audience to view his hero in "the tragic glass." Ben Jonson ventured into tragedy in his own scholarly, methodical way, boasting to have discharged all the crucial "offices of a Tragic writer," which he lists straight out of Aristotle. Milton's choice of the tragic form to express his final mood was of course deliberate and, especially in relation to the tragic undertones of his great epic, significant. Artists are free--but free to choose their own sort of bondage. It is they and not so much the critics who have worked to maintain the integrity of the forms. Their conscious, explicit choices show that in their eyes the forms are real, and different, and not merely an academic conspiracy. The phenomenon is a powerful example of the fruitful interaction of tradition and individual talent. (shrink)

This does not mean that it is always satisfying, however, and (...) since Hall tries to find a blend of “exuberant praise and testy complaint” (p. 7), this review will adopt the same method.On the positive side, perhaps there is no better way to approach Rorty than by employing Rorty’s own method of reading philosophical and literary works: narrative recontextualization. Since Hall states, “Deductive and dialectical logics are irrelevant to (Rorty’s) thought” (p. 9), he had to find a means of avoiding the point/counterpoint strategy of direct argumentation so as to do justice to Rorty’s own conversational strategy of reading texts. Thus, Hall (compared, for example, to Konstantin Kolenda) is unique in his willingness “to follow Rorty through the looking glass” (a reference to Rorty’s discarding the traditional metaphor of the mind as a mirror) and to take seriously Rorty’s thinking as “beyond the philosophical pale” (p. 3). Hall makes a virtue of his strategy: “The best one can do is to judge the relative attractiveness of Rorty’s views by recourse to alternative visions” (p. 4). The breadth of Hall’s background in philosophy, both Eastern and Western, his fine ear for irony, and his acute sense of history make him an exemplary reader who can offer attractive alternate visions by which to examine Rorty’s own vision.The subtitle of the book (“Poet and Prophet of the New Pragmatism”) announces Hall’s underlying theme; he takes his cue from the pragmatic Deweyan aspect of Rorty’s work, with the phrase “new pragmatism” referring to Rorty’s reinterpretation of pragmatism along linguistic lines. Where the original emphasis of pragmatism was on ideas as habits through which experience could be guided for the satisfaction of desires in terms of either private or public goods, Rorty’s neopragmatism replaces ideas and experience with language and alternate vocabularies as the medium through which desires are fulfilled. With this emphasis on language comes Hall’s reading of Rorty as poet and prophet. The desire for self-creation is accomplished through poetry and literature. The desire for social tolerance is marked by Rorty’s commitment to a form of Utopian Democracy. Hall’s reading of Rorty is well grounded in the mutations of Pragmatism from Peirce to Davidson and from aesthetics to social theory.On the negative side, a number of Hall’s claims are open to objection, some of them are minor, some more substantive. Of the minor variety is a footnote for Chapter 2: “Rorty’s Ph.D. dissertation was on Whitehead and Aristotle”—whereas, in Rorty’s dissertation, The Concept of Potentiality (Yale, 1956), Whitehead appears only in the bibliography and is not mentioned in the text at all. On the other hand, except for an acceptance of the secularization of the public realm, there seems to be little in his thinking that characterizes him as an “Enlightenment” figure, and Hall himself seems to concede this when he later refers to Rorty as a “Nihilist” (p. 170). Taking Isaac Newton at his own word, historians have long agreed that the decade of the 1660s, when Newton was a young man in his twenties, was the critical period in his scientific career. In the years 1665 and 1666, he has told us, he hit on the ideas of cosmic gravitation, the composition of white light, and the fluxional calculus. The elaboration of these basic ideas constituted his scientific achievement. Nevertheless, the decade of the 1660s has remained a virtual (...) blank in our knowledge of Newton. It need not remain so always. His papers contain a wealth of manuscripts from his undergraduate years and the period immediately following. The first volume of his mathematical papers, which will soon be published, will demonstrate how extensive the information on his early mathematical development is. The development of his non-mathematical studies, especially of what I shall call his scientific studies to distinguish them from the mathematical, can be followed as well—in his reading notes, in his notebooks, above all in the passage in his philosophical notebook labelled Quaestiones quaedam Philosophicae. This study examines the effect of a business ethics course on undergraduates’ attitudes toward the importance of corporate ethics and social responsibility, as measured by the PRESOR scale. It employs a survey approach, adopting a pretest/posttest methodology in the data collection. A total of 132 undergraduate students were surveyed over a period of four semesters during 2006 and 2007. To test the effects of individual personality characteristics and examine their potential interaction with ethical education, participants’ personal values and degree of (...) Machiavellianism were also assessed. The business ethics course resulted in significantly less support for the traditional “stockholder view” of business, providing backing for the inclusion of a stand-alone business ethics course in the business studies curriculum. In addition, among nonbusiness majors, the course resulted in significantly greater support for the “stakeholder view,” suggesting that it would be especially beneficial to open such a course to nonbusiness students. From the very day in 1686 when Edmond Halley placed Book I of the Principia before the Royal Society, Robert Hooke's claim to prior discovery has been associated with the law of universal gravitation. If the seventeenth century rejected Hooke's claim summarily, historians of science have not forgotten it, and a steady stream of articles continues the discussion. In our own day particularly, when some of the glitter has worn off, not from the scientific achievement, but from the character of (...) Newton, there has been a tendency vicariously to atone for the treatment Hooke received. The judgement Lohne cites with approval from Vavilov appears to summarize the current estimate of the issue—in the seventeenth century only Newton could have written the Principia; nevertheless Hooke first sketched out its programme. What with all the knocks he has received both alive and dead, one feels guilty in assuming the role of “debunker” at this late date. Apologetically draped in sackcloth then, head covered with ashes I venture softly to suggest that Hooke has received more than his due. There is no question here of justifying Newton's behaviour toward Hooke. Wholly lacking in generosity as it appears to me, Newton's behaviour neither deserves nor can receive justification. The question turns rather on Hooke's scientific theories. Granting always his lack of demonstrations, historians have been prone to interpret his words in the light of Newton's demonstrations. A close examination of Hooke's writings does not sustain the interpretation. Contrary to what is generally asserted, he did not hold a conception of universal gravitation. And if he announced the inverse square relation, he derived it from such a medley of confusion as will not allow his claim to priority. (shrink)

Almost exactly ten years ago, the now extinct U.S. Congress, Office of Technology Assessment (OTA) released a major report -- The Electronic Supervisor: New Technology, New Tensions. This report describes a number of new technologies available to management in its ongoing search to ensure that labour performs its required job to management's rigid specifications. Social issues raised with respect to electronic monitoring included privacy, fairness, quality of working life, and stress-related illnesses. The study was also concerned with drug testing, genetic (...) screening, polygraph testing, as well as a variety of technologies for eavesdropping and monitoring. It seems to be appropriate to evaluate the analyses and recommendations made in the report and to extend the evaluation to current technologies. (shrink)

How transcription factors achieve their in vivo specificities is a fundamental question in biology. For the Homeotic Complex (HOM/Hox) family of homeoproteins, specificity in vivo is likely to be in part determined by subtle differences in the DNA binding properties inherent in these proteins. Some of these differences in DNA binding are due to sequence differences in the N‐terminal arms of HOM/Hox homeodomains. Evidence also exists to suggest that cofactors can modify HOM/Hox function by cooperative DNA binding interactions. The Drosophila (...) homeoprotein extradenticle (exd) is likely to be one such cofactor. In HOM/Hox proteins, both the conserved ‘YPWM’ peptide motif and the homeodomain are important for interacting with exd. Although exd provides part of the answer as to how specificity is achieved, there may be additional cofactors and mechanisms that have yet to be identified. (shrink)

The human science or qualitative approaches to research have always argued that methodology must be determined by the subject matter under study. Yet the same approaches to data collection (i.e., the qualitative interview) and data analysis have been utilized by these approaches since their inception. The most essential lesson of van den Berg's metabletics is that no phenomenon is static or absolute. If human phenomena are ever-changing then the methodologies we use to study them must also change and adapt, so (...) that we can more fully and authentically capture their meaning structures. This paper will develop this argument, and demonstrate the limitation of interviews for the study of the changing nature of human phenomena, utilizing psychotherapy research as an example. (shrink)

In El Salvador from 1978 to 1988, contraceptive use among married women 15–44 years of age increased from 34% to 47%, and the total fertility rate declined from 6·3 to 4·6 children per woman. Most of this change took place from 1978 to 1985. Sterilization is the most prevalent method used, but nearly one-half of the women who are sterilized did not use any contraception before their operation. Few young couples use reversible methods of contraception to space births or delay (...) the start of childbearing. Although researchers have begun to examine how firms manage their entire web of stakeholder relationships, the component relationships also require theoretical and empirical examination. Several studies have found that Employee Stock Ownership Plans (ESOPs) have a positive impact on firm performance. The authors explain these results by hypothesizing that ESOPs, when combined with employee participation programs, forge a stakeholder relationship between management and employees. The authors offer criteria for identifying stakeholder relationships, provide background on ESOPs, analyze why they contribute to (...) establishing such a relationship, and examine how published empirical research supports this analysis. Every constitution defines and is defined by a period in time. Like all law the creation and application of constitutions require reference to the past and future respectively. Every instance of constitution‐making is an attempt to control behavior over an extended period of time. Therefore constitutions will be drafted, both in style and substance, to reflect that temporal ambition. The effectiveness of a constitution also requires that its interpretation makes reference to the understanding of its rules held by the constitution‐makers. (...) As a result, and notwithstanding the efforts to make it suitable over a long period by its creators, every constitution is bound to become unsuitable. Courts employ a number of devices to cope with the inevitable obsolescence of constitutions but, sooner or later, every constitution will have to be discarded and a new constitutional era begun.
